Houston police and news outlets have reported that an 8-year-old girl was found deceased in a hotel pool late on Saturday, March 23rd. The hotel is located in northwest Houston near Highway 290.

Police found the girl after responding to reports that she was missing. After initially being unable to locate the girl, the Houston police contacted several agencies for assistance, including the Texas EquuSearch and the Texas Department of Criminal Justice, which possessed a long pole with a camera to help aid the search. Houston firefighters searched the lazy river-style pool and the four pipes connected to the pool without success.

Police ultimately found the girl stuck inside one of the pool’s pipes, which were 12 inches in diameter. Paramedics pronounced the girl dead at the scene.

Swimming Pool Accidents and Hotel Liability

Annually, there are thousands of fatal drownings in the U.S. Tragically, swimming pool accidents are one of the leading causes of death for children aged between 1 and 15.

Because swimming pools are so dangerous, Texas law imposes a legal duty to keep invited guests at the pool reasonably safe. This duty may require owners to:

  • Make sure the pool and pool deck are reasonably free from hazards
  • Warn invitees of concealed hazards
  • Install a fence around the pool to prevent minors from falling in
  • Ensure safety equipment is available and in good working order
  • Have a lifeguard to monitor swimmers

When hotels and other swimming pool owners fail to satisfy this duty, and the pool causes an injury or wrongful death to a guest, they can be liable for negligence.
