What Lost Time Benefits Are Available to Injured Workers in Houston, Texas?

Under Texas law, these are the different types of income benefits:

  • Temporary Income Benefits (TIBs)
  • Impairment Income Benefits (IIBs)
  • Supplemental Income Benefits (SIBs), and
  • Lifetime Income Benefits (LIBs).

These benefits are intended to make up for the loss of income you experience while you’re (a) unable to work or (b) limited in how much you can work.

Here’s a brief overview of each of these benefits and how they can provide some relief after you’re hurt while working in Houston.

Temporary Income Benefits

TIBs benefits are available if you’re unable to work for more than seven days.

You can recover 70 percent of the difference between:

  • Your average weekly wage before you got hurt or sick, and
  • What you’re able to earn after your injury.

There are caps on how much in TIBs benefits you can receive. If you were (are get) hurt on the job between October 2021 and September 2022, TIBs benefits max out at $1,058. You’re entitled to receive at least $159.

TIBs benefits are available until you reach maximum medical improvement (MMI), are able to earn your pre-injury paycheck, or 104 weeks have passed.

Impairment Income Benefits

If your injury results in permanent impairment or disability, then you may qualify for IIBs. After you reach MMI, a healthcare provider will assign an “impairment rating” based on the impact of your injury. 

IIBs equal 70 percent of your average weekly wage. You can recover three weeks of IIBs for each percentage of “impairment.” 

If your impairment rating is 30 percent, then you’ll be eligible for 90 weeks of IIBs.

Supplemental Income Benefits

You may qualify for SIBs if your impairment rating is greater than 15 percent, you’re looking for work, and you haven’t returned to work. You can also qualify if you have returned to work but are earning less than 80 percent of the average weekly wage in your position because your injury is so severe.

You cannot receive supplemental benefits if you opt to receive a lump sum payout.

SIBs equal 80 percent of the difference between your average weekly wage and whatever you were able to earn after your work-related injury.

Lifetime Income Benefits

Lifetime income benefits make up for lost income if you suffer a catastrophic injury, such as an amputation, paralysis, or burns.

LIBs are equal to 75 percent of your average weekly wage. You’ll see a three percent increase in benefits each year.
