How Attorney Brian White Personal Injury Lawyers Can Help After an Amazon Van and Truck Accident in Houston
Amazon delivery vehicles are everywhere in Houston nowadays. These drivers are subject to tight delivery deadlines and are often in a hurry to deliver packages to customers’ doorsteps. It’s not entirely surprising that Amazon drivers cut corners and cause accidents.
Victims often believe that they can sue Amazon for damages if they’re hurt. In reality, motor vehicle accidents involving Amazon are much more complicated. Amazon doesn’t even own the vast majority of the vans and trucks you see on the roads.
When you’re hurt in an Amazon accident, you’ll probably have to deal with multiple insurance companies. You can expect each company to deny responsibility. When the insurance companies start pointing the finger at someone else, a Houston personal injury lawyer can help.

When you hire Attorney Brian White Personal Injury Lawyers, you’ll have to:

What is My Houston Amazon Van and Truck Accident Case Worth?
Speaking with an experienced attorney is the best way to get an accurate idea about how much your case is worth. However, there are some factors that are relevant in nearly every case.
The key factors that are important to judges and juries include:
- The nature and severity of your injuries
- The anticipated duration of your medical treatment and recovery
- The value of your out-of-pocket costs, including lost wages and income
- Whether your quality of life has been diminished
- Your past and future emotional and physical pain and suffering
Insurance coverage limits are also important if your accident involved an Amazon van or truck. While you may have the right to pursue a personal injury lawsuit against the at-fault driver, insurance will pay the majority of your compensation.

What Insurance Coverage Requirements Apply to Amazon Drivers?
Many Amazon drivers are independent contractors. Amazon recruits Texas residents who already own vans and trucks to deliver packages throughout the Houston area. Enrolling in the Amazon Flex program gives many drivers the flexibility to work when they want and earn extra money. The driver simply uses their personal vehicle as a delivery van.
It can also create an insurance headache when an Amazon driver causes an accident.
When a Texas driver purchases auto insurance, that insurance doesn’t apply when the driver is using a vehicle for commercial purposes. Delivery companies are out to make a profit. That means many insurance companies will deny coverage if the driver is involved in an accident while delivering packages.
Fortunately, Texas law classifies Amazon vans and trucks as “transportation network companies.” Much like Uber and Lyft, Amazon is required to provide a minimum level of insurance coverage to protect accident victims.
Amazon Flex is now required to provide insurance coverage of:
- $50,000 for bodily injury or death per person
- $100,000 for bodily injury or death per accident
- $25,000 in property damage coverage
Amazon provides this commercial insurance coverage at no cost to the driver. It applies at any time when the approved Amazon driver is delivering packages in their designated area.

Can I Sue Amazon for Damages?
Amazon Flex drivers are classified as independent contractors. However, some drivers are actual Amazon employees. Under Texas laws, employers are responsible for any negligent acts their employees commit while on the job.
Under Texas state law, Amazon could be liable for damages as an employer if:
- The at-fault party was an Amazon employee
- The employee was negligent while acting in the course and scope of employment
That includes while driving an Amazon van or truck.
What Types of Damages Are Available to Amazon Van and Truck Accident Victims?
Texas personal injury law gives injured parties the right to recover economic damages and non-economic damages after an accident.
Economic damages include:
- Past and future medical expenses
- Lost wages
- Lost future earning capacity
- Rehabilitation
- Property damage
If you’re seriously hurt, you’re also entitled to file a claim for non-economic damages, which provide compensation for:
- Pain and suffering
- Emotional distress
- Disfigurement and scarring
- Other physical impairments
- Anxiety and depression
- Loss of enjoyment of life
- Loss of consortium
Amazon van and truck accidents also have the potential to be fatal. If you lost a loved one, our Amazon truck accident lawyers in Houston could help you file a wrongful death lawsuit for additional damages.
Can I Recover Damages If I’m Being Blamed for an Amazon Van and Truck Accident in Texas?
Insurance companies often try to avoid responsibility by blaming someone else. Texas is a modified comparative negligence state. Accident victims have the right to recover compensation unless they are 51% or more to blame for an accident.
A personal injury lawyer can help if you’re being blamed for an Amazon accident. Just call our law offices to schedule a free consultation today.
