How Will a Car Accident Lawyer in Houston Help After an Accident With a Drunk Driver?
When someone operates a car under the influence of drugs or alcohol, they lose the ability to do so safely. Reaction times decrease. They’re more likely to fall asleep or get distracted. The chances of losing control of the vehicle skyrocket. So, when a drunk driver is on the road, serious accidents can happen. While the drunk driver can certainly get hurt in these crashes, others can, as well. Many times, the injuries resulting from drunk driving accidents can be catastrophic, if not fatal.
This means that you might have a long road to recovery. It might take months or years to get back to life as you knew it. Or, life may never be the same again. This can be physically, emotionally, and financially devastating. You can and should hold the drunk driver personally and financially accountable.
However, getting money is often easier said than done. Drunk drivers can be arrested and charged with a crime, which can delay your injury case. Insurance companies and other interested parties certainly won’t make the process easy.
By hiring an attorney, you can focus on getting better, level the playing field, and position yourself to secure a substantial monetary award.

How Common Are Drunk Driving Accidents in Houston?
Drinking and driving is incredibly common. In fact, in 2018, one out of every 227 licensed drivers in the United States was arrested for driving under the influence. That adds up to more than 1,001,320 drunk driving arrests in a single year.

How Might Criminal DUI Charges Affect a Personal Injury Lawsuit?
Drunk driving is illegal in the state of Texas. It’s quite possible that, following a drunk driving accident, the impaired driver is arrested and charged with DUI. That could potentially affect your personal injury case.
Keep in mind that the criminal and civil cases are distinct. You still reserve the right to file a lawsuit against a drunk driver, even if they’re charged with a crime. The proceedings are separate and, technically speaking, have no bearing on one another.
However, when a drunk driver is charged with a crime, your civil case might be put on hold for a period of time. Defendants can ask to have related civil cases stay so that they can focus all of their time, energy, and attention on defending themselves against criminal charges. Your civil personal injury case would resume whenever the criminal case was resolved.
The outcome of that criminal case wouldn’t necessarily have an impact on your case. You can still get money even if the driver is acquitted or negotiates a plea. The standards of proof in civil and criminal cases are much different. Criminal charges are much more difficult to prove. However, the fact that the driver is convicted of DUI can certainly work in your favor. You can use that to establish that the drunk driver was negligent, which will be critical to recovering compensation.
At Attorney Brian White Personal Injury Lawyers, we understand that a criminal DUI case can impose certain challenges for your personal injury case. We also know how to handle these curveballs and help you navigate the process. Don’t hesitate to reach out to us for assistance. We offer a free initial consultation, so the time to call is now.
