Are you struggling with injuries because you were recently assaulted in Houston, TX? The person who attacked you might be charged with a crime. However, that won’t put money in your hands when you need it most.
Fortunately, you can hold them personally liable for the harm and suffering they’ve inflicted. How? By filing a civil assault injury lawsuit against them.
How Will a Personal Injury Lawyer Help Me If I Was Assaulted in Houston?
Assault isn’t just a crime. It’s also an intentional tort. This means that you may have the right to file a civil lawsuit to recover compensation if someone else intentionally threatened, attacked, or physically injured you. In fact, you might even have a valid case against someone other than your attacker, such as a business owner or employer.
However, lawsuits can be time-consuming and stressful. They can be incredibly overwhelming at a time when you are struggling to recover from physical and emotional wounds.
Other parties and insurance companies certainly won’t go out of their way to make things easy for you. Fortunately, you don’t have to do this on your own. You can and should enlist the help and guidance of our personal injury attorneys.

Do I Have a Civil Assault Case?
Assault is both a crime and a civil wrong. While these are different – a person can face criminal assault charges and be sued for the harm they cause – the act of assault is defined the same way for both. In Texas, assault can be defined in three distinct ways.
Assault occurs when a person:
- Intentionally, knowingly, or recklessly causes bodily injury to someone else;
- intentionally or knowingly threatens another person with imminent bodily injury; or
- Intentionally or knowingly causes physical contact with another when the person knows or should
- reasonably believe that the other will regard the contact as offensive or provocative.
So, you might have a legitimate and valid civil assault lawsuit if you have been threatened, touched, or physically harmed by another person.

Who Else Might Be Responsible For My Assault Injuries?
While you can sue the person who attacked you, it’s important to consider that a lawsuit against them might not yield a lot of money. Even if you win, they can really only pay as much as they have.
If they don’t have a lot of money, resources, or assets, your recovery might not amount to what you really need or deserve. Fortunately, your attacker isn’t the only one who might be liable for your injuries.
In Texas, anyone who contributes to an assault can also be financially liable for the consequences. This could include:
- Businesses, including bars, restaurants, nightclubs, entertainment venues, and stores
- Property owners
- Landlords
- Employers
- Schools and school administration
- Daycare centers and caretakers
- Houses of worship and clergy, and
- Government agencies.
A lawyer will carefully review your case to see if you might have a premises liability, negligent security, or another type of negligence claim.

How Long Do I Have to File a Civil Assault Lawsuit in Houston, Texas?
In Texas, victims of assault typically have up to two years to file a personal injury lawsuit against their attacker and/or other parties. There are certain times when the statute of limitations will provide more or less time to do so. However, if you don’t file a lawsuit within the applicable time period, you will lose the right to recover any compensation, at all.
What if the person who attacked you is charged with assault in Houston? You can still file your lawsuit against them. However, be prepared for the possibility that your civil case might be put on hold for a little while.
That’s because defendants can ask a court to pause – or stay – a civil case that’s filed against them so that they can focus all of their energy on their criminal case. If a stay is granted, your civil case would resume once the criminal case is resolved one way or another.
Will the outcome of a criminal assault case affect your civil assault case? Not necessarily. Legally and procedurally speaking, they’re separate. The burdens of proof are different. It’s much easier to satisfy the burden of proof in a civil case than it is in a criminal case.
So, it’s possible that the person who attacked you won’t be convicted, but will be determined to be liable for your injuries. At the same time, if they are convicted or plead guilty, that can certainly benefit your demands for compensation.
