Who Can File a Wrongful Death Claim in Texas?
Texas does not let just anyone file a wrongful death lawsuit. The right to sue belongs to a short list of family members, and filing without that right can cost your family months it cannot spare. Under Texas Civil Practice and Remedies Code § 71.004, these people can bring the claim:
- The surviving spouse
- Children of the deceased
- Parents of the deceased
Any one of them can file for the benefit of all. Siblings, grandparents, and other relatives cannot file, even if they were close to the person who died. If no eligible family member files within three months of the death, the executor or administrator of the estate must file, unless all the eligible family members ask them not to. If the case goes to trial, the jury decides how to divide the award among the eligible family members.
The estate may also hold a separate survival claim under Texas Civil Practice and Remedies Code § 71.021. It covers what your loved one suffered between the crash and their death, including medical bills and physical pain. The estate’s representative or the heirs bring it, and it is separate from the wrongful death claim your family brings. Our Channelview personal injury lawyers identify both claims at the start and make sure the right person files each one.

What Causes Fatal Crashes in Channelview?
Most fatal crashes come from a handful of dangerous choices behind the wheel:
- Speeding, especially on high-speed corridors like the I-10 feeder
- Drunk or impaired driving
- Distracted driving, including phone use behind the wheel
- Running red lights or stop signs
- Commercial truck driver fatigue on long hauls
The cause of the crash tells us who owes your family compensation, and each cause opens a different path to recovery. If a drunk driver caused the crash, that driver’s auto insurer is one source of payment. A bar or restaurant that served the driver while the driver was obviously intoxicated and a clear danger to others can also be liable under Texas dram shop law. If a truck driver fell asleep at the wheel, the trucking company that pushed the driver to keep going may share responsibility.
A criminal case does not stop a civil claim. Your family can pursue a wrongful death lawsuit whether or not prosecutors file charges.
Every responsible party is another potential source of recovery for your family, and a crash often involves more than one. Our fatal car accident lawyers in Channelview identify all of them before we make a single demand.

When Employers Have Liability in Car Accident Cases
When an employee causes a deadly crash, the company behind that employee often bears part of the blame. A trucking company is directly liable when it pushes drivers past federal hours-of-service limits, skips required maintenance, or hires a driver with a poor safety record. An employer is also liable when an employee causes a crash while doing the job, even if no manager was anywhere near the vehicle. This is called vicarious liability.
Companies rarely hand over the evidence that proves these claims. We send preservation letters early so the company cannot lose or discard key records, then use the discovery process to obtain logbooks, maintenance files, hiring records, and internal communications.
Delivery and rideshare cases turn on what the driver was doing when the crash happened. Rideshare companies must carry much higher insurance coverage once a driver accepts a ride request or has a passenger in the car. Commercial policies for delivery companies are often far larger than a personal auto policy. That difference can decide whether your family recovers enough to cover its losses.

What a Car Accident Lawyer Can Do for Your Family
A Channelview fatal car accident attorney does far more than file paperwork. In a fatal crash case, we will:
- Investigate the scene and gather police reports, camera footage, and expert analysis
- Identify every liable party and every insurance policy that applies
- Calculate what your family has lost and will lose in the future, including income, support, and the care your loved one provided
- Negotiate with insurance adjusters, who often try to minimize fatal crash claims
- Take your case to trial if the insurer refuses to offer a fair settlement
You should not have to manage any of this while you grieve, and a single mistake can weaken a claim permanently. We take that burden off your family so you can focus on healing.

Compensation Families May Recover
No settlement replaces a loved one. It can, however, keep a family from carrying the cost of someone else’s negligence on top of its grief. Texas law allows two types of claims, and each recovers different losses.
The wrongful death claim belongs to the spouse, children, and parents. It can cover:
- Loss of the deceased’s financial support and services
- Loss of companionship, advice, and counsel
- Mental anguish
- Loss of inheritance
- Punitive damages, when the defendant’s willful act or omission or gross negligence caused the death
Money recovered in a wrongful death claim is not subject to the debts of the person who died.
The survival claim belongs to the estate and heirs. It can cover:
- Medical expenses before death
- The deceased’s pain and suffering before death
Funeral and burial expenses are also recoverable, depending on who paid them.
Insurers know families are most vulnerable right after a death, and they often make a quick offer hoping you will accept it to end the process. Once you accept, you cannot go back for more. We evaluate every part of your claim before we accept any number, so your family does not settle for less than the case is worth.
Don’t Wait Too Long to Act
Texas gives families two years from the date of death to file a wrongful death lawsuit under Texas Civil Practice and Remedies Code § 16.003. If you miss the deadline, the court will generally dismiss the case, no matter how clear the liability was.
Evidence disappears much sooner than that. Businesses overwrite camera footage, often within weeks. Repair shops fix wrecked vehicles, and salvage yards crush them. Witnesses forget details or move away. Every week of delay costs your family proof, and that proof is often what decides a case. Call us now so we can start protecting it.
