Is Distracted Driving a Crime?
Distracted driving is a broad category of behavior that can take many forms. Not all of the behaviors that fall under this category are a violation of Texas law. For example, there are ways that a person can be cognitively distracted from the road, like talking with friends or singing along to music.
Likewise, there are ways that a person can be physically distracted from the road. Parents driving unruly children around may have their attention divided between their kids and the traffic. Other drivers may be eating, looking at a map, or changing the music on the radio, and thus looking away from the road.
Texas law prohibits drivers from reading, writing, or sending electronic messages while operating a motor vehicle, subject to certain exceptions. However, distracted driving is not limited to texting. A driver who causes an accident because they were not paying attention may still be held liable for the resulting injuries, even if their conduct did not violate a specific distracted driving statute.
How to Prove Distracted Driving After an Accident
To recover compensation after a distracted driving accident, you generally must establish that the other driver was negligent and that their lack of attention caused your injuries.
Our Channelview personal injury lawyers can investigate the accident and gather evidence to determine whether the other driver was distracted. Depending on the circumstances, that evidence may include witness statements, phone records obtained through appropriate legal procedures, photographs, surveillance footage, and the police crash report.

How Is Compensation Calculated After a Distracted Driver Collision?
The best way to prevent insurance adjusters from misrepresenting your losses or pressuring you into accepting an insufficient settlement offer is to calculate the value of your damages ahead of time. Our attorneys will do this by assessing the value of your economic and non-economic losses.
Economic damages include measurable financial losses, such as medical bills, lost wages, and property damage. These losses can often be documented through medical records, billing statements, pay stubs, and repair estimates.
We also evaluate non-economic damages, including physical pain, mental anguish, and physical impairment, which may not have a readily identifiable dollar value.
