Injuries You Could Receive From a Rear-End Collision
Most people turn to our Channelview personal injury lawyers when they are injured in some way due to an accident. In rear-end collisions, we commonly see injuries like:
- Whiplash and other soft-tissue damage injuries
- Back injuries
- Concussions or traumatic brain injuries
- Shoulder and wrist injuries
- Facial injuries from airbags
These injuries need to be documented for your insurance claim or lawsuit, and some injuries may not appear until a few days have passed after your accident. See a doctor as soon as you can after your accident to protect your health and your case’s value.

Who May Be Liable?
In a rear-end crash, the presumption of fault is on the rear driver. If a driver is distracted by texting or is following too closely, it’s easy for a rear-end accident to happen. That said, sometimes the front driver is the one to blame, or fault may be shared between both.
There can also be third parties that could be liable for your accident. Rear-end crashes are common in chain-reaction crashes, so there may be multiple parties in those cases. Untangling who has the most fault may need the assistance of a Channelview rear-end collision lawyer.
Furthermore, if the one responsible was working at the time of the crash, their employer may also have a share of the blame. Our attorneys will carefully examine what happened to find all liable parties. This helps us maximize your compensation.

How Insurers Approach These Cases
Insurers perform their own investigation into any crash to fight insurance fraud, but they also do it to find ways to reduce the amount of money they owe. If you only have minor injuries or delayed injuries, it can be harder to persuade the insurer.
For example, they might question whether your injury was pre-existing before the crash. They might also question whether your injury happened after the crash. Seeing a doctor as soon as possible after the crash can shut these arguments down through your medical records.
This is just one way they can fight back, but we know how to counter their arguments. You don’t need to face experienced opposing attorneys on your own. Instead, have our team investigate what happened, calculate the value of your claim, and fight hard with the insurers to get you the money you need.

What Could I Recover from My Channelview Accident Claim?
When you make an insurance claim or a civil lawsuit, you’re asking for compensation for certain “damages” you have suffered. These fall into two broad categories.
Economic damages are the direct financial costs you’ve suffered. These are damages that have or could have a specific bill attached to them, like a hospital bill or a car repair bill. These include:
- Medical expenses related to your injury, both now and in the future
- Property damage to your car and other personal property
- Any medical equipment you need to accommodate a disability
- Lost wages and other income losses
Non-economic damages are damages allowed by law to cover the intangible harms you’ve experienced because of the crash. The most well-known of these is “pain and suffering,” which covers the experience of physical pain and the mental suffering related to it, but there are others.

Board-Certified in Personal Injury Trial Law
Attorney Brian White is board-certified in personal injury law by the Texas Board of Legal Specialization. Very few personal injury lawyers in Texas have this specialization. To get it requires years of trial experience, a review of their trials by other lawyers and judges, and a rigorous exam.
An attorney with this credential shows insurers that they’re not facing an inexperienced lawyer. They know that we have experience in taking insurers to trial and are not afraid of litigation. This can make an insurer much more willing to settle for a proper amount of compensation to avoid the higher chance of a loss in court.
Our Channelview rear-end collision lawyers prepare every case as if it might go in front of a jury. If the insurers do decide to go to trial anyway despite our experience, we’ll be ready.
Our Attorneys Work on Contingency
We represent our clients on a contingency fee basis. What does this mean? There is no upfront cost for you to hire our firm. You won’t get an hourly bill nor have to pay a retainer fee before we take your case. Our initial consultations are also free of charge.
You pay us only if you hire us and we win compensation for you. Anyone can get injured, so we believe this is the fairest way to let everyone get legal representation for an accident without financial pressure.
Should you recover money, you will pay us a percentage of the final amount. This adds another advantage for you. It gives us reason to fight to win you as much money as we can. The more we can win, the more we can collect from our final fee.
You Must Start Your Case Early
Texas law gives injury victims two years from the date of your crash to file a personal injury lawsuit. Once this deadline passes, the court will refuse to hear the case no matter how much it is in your favor.
This deadline, called the statute of limitations, exists to make sure courts can hear evidence fairly before time decays its value. It also keeps plaintiffs from holding cases over the heads of defendants.
There are some situations where this window can be shortened even more. If you’ve been injured in a rear-end crash, it’s best to contact a Channelview rear-end collision lawyer as soon as possible. This makes sure your lawyer has the most time to investigate what happened before a lawsuit.
