Uber accidents can cause significant injuries. You may be left with piles of medical bills and significant lost income. You’re probably wondering who will pay your bills while you recover?

This philosophy has helped us recover tens of millions of dollars over our decades of practice. Our founding attorney Brian White has even obtained Board Certification in Personal Injury Trial Law to better serve our clients.

What Types of Damages Are Available to Uber Accident Victims?
Compensatory damages compensate accident victims for their losses. Texas law classifies damages as economic or non-economic, depending on the loss.
Economic damages represent financial losses. Most Uber accident victims will be entitled to money for:
- Past and future medical expenses
- Lost wages
- Lost future earning capacity
- Rehabilitation and specialized care
- Property damage
Non-economic damages in Texas compensate victims for personal, subjective losses, including:
- Pain and suffering
- Mental anguish
- PTSD
- Anxiety and depression
- Disfigurement and scarring
- Loss of enjoyment of life
- Loss of consortium
Your insurance settlement should include the full range of damages you deserve. Unfortunately, insurance companies often try to diminish or downplay a victim’s injuries.

Can I Recover Damages If I’m Being Blamed for an Uber Accident in Texas?
Texas modified comparative negligence law imposes a 51% bar to recovering damages. That means Uber accident victims can recover compensation if they’re partly to blame for the accident–but not if they’re mostly responsible.
If you’re being blamed, take these allegations seriously. You could wind up with less money in your pocket if the insurance company can prove you were even slightly responsible. You might even walk away with nothing.
Our lawyers can help minimize the impact of contributory fault in your case. Reach out to Attorney Brian White Personal Injury Lawyers today to learn more.

What Causes Most Uber Accidents in Texas?
Crashes involving Uber and Lyft happen more often than you might think. Rideshare drivers might spend a lot of time behind the wheel, but they’re not always safe drivers.
In fact, Uber and Lyft drivers are often distracted by their phones and GPS devices when accepting rides and locating passengers in unfamiliar locations.
Some of the most common causes of Uber accidents in Texas include:
- Distracted driving
- Fatigued driving
- Stopping suddenly to let passengers out or pick them up
- Stopping in prohibited areas
- Speeding and aggressive driving
- Failure to yield the right-of-way
- Tailgating
- Unsafe passing
- Illegal lane changes
- Illegal or unsafe turns
- Running a red light or stop sign
- Drunk driving
- Hazardous road conditions
- Defective vehicles or vehicle safety equipment
- Failure to maintain the Uber vehicle
Pedestrians, bicyclists, and third-party drivers may also share responsibility in an Uber or Lyft accident.
Who Pays My Damages After an Uber Accident in Texas?
Liability in an Uber accident case depends on a few different factors, including:
- What the Uber driver was doing at the time of the accident
- Who was involved in the crash
- The severity of your injuries
We all know the basics of how Uber works. Uber drivers are independent contractors who use their personal vehicles to offer transportation to rideshare users. They log into an app, accept a ride, and transport the passenger from point A to point B for a profit.
Because Uber drivers use their cars to earn a profit, their personal insurance policies may not cover the damages if they’re involved in an accident. Fortunately, Texas requires Uber to provide commercial insurance coverage.
If you’re injured in an accident, you may be entitled to recover damages from:
Uber’s Insurance Policy
Uber’s insurance provides two different levels of insurance coverage, depending upon the driver’s status at the time of the accident.
If the driver was logged into the app but had not accepted a passenger, a limited policy provides coverage for up to:
- $50,000 in bodily injury per person
- $100,000 in bodily injury per accident
- $25,000 in property damage per accident
The moment the driver accepts a passenger’s ride request, more generous coverage limits kick in. Uber provides a $1 million policy that remains effective from the time the driver accepts a ride until the passenger is dropped off.
However, Uber insurance offers only secondary coverage. That means you’ll have to exhaust all other forms of insurance before you can file a claim.
The Uber Driver’s Insurance Policy
The Uber driver’s personal car insurance policy applies if the driver was not logged into the Uber app. In other words, the rideshare company won’t be involved at all if the driver was off-duty.
Negligent Third Parties
Someone other than the Uber driver may have caused your accident. If that’s the case, you’ll have to seek compensation from those parties.
Responsible parties might include:
- Third-party drivers
- Truck drivers
- Pedestrians
- Bicyclists
- Government agencies
- Manufacturers of defective vehicles
Finding out who was responsible is the first step to recover damages after an Uber accident. If you’d like to have an experienced car accident lawyer review your claim, call our law firm for a free case evaluation today.
How Do I Prove Negligence After an Uber Accident in Texas?
Identifying the responsible parties is only the first step in an Uber accident case. You’ll also have to offer proof about why that person is responsible.
Most rideshare accident claims are based on negligence. Negligence means:
- The at-fault party breached a legal duty of care
- The breach caused your accident
- You suffered damages
It’s also possible that strict liability laws may apply. For example, if you were hurt because of a defective airbag, the product manufacturer may be subject to strict liability laws in Texas.
How Long Do I Have to File a Lawsuit After an Uber Accident in Texas?
Uber accident victims in Texas only have a short window of time to take legal action. The statute of limitations gives injured parties two years to file a personal injury lawsuit.
After the deadline passes, you’ll lose your right to compensation. The best way to protect your legal rights is to speak with an experienced lawyer quickly after your accident.
