What Causes Most Pedestrian Accidents?
Every year, thousands of pedestrians are injured in traffic accidents across the state of Texas. According to the Texas Department of Transportation, 5,921 pedestrian accidents were reported statewide in 2023.
That’s roughly 16 pedestrian accidents every single day – of which at least two are fatal.
The sad truth is that most of these pedestrian accidents can be avoided. They’re typically the result of poor decisions, mistakes, and lapses in judgment. This is why the main cause of action for pedestrian accident cases is negligence.
Some of the top contributing factors to Burnet pedestrian accidents include:
- Distracted driving
- Speeding
- Driver fatigue
- Drug and alcohol use
- Illegal turns
- Improper passing
- Failing to look for a pedestrian in a crosswalk
- Rolling stops at an intersection
- Running red lights and stop signs
- Braking errors
- Unmarked crosswalks
- Broken or damaged sidewalks
- Inadequate lighting
- Ignoring Texas traffic laws
- Vehicle malfunctions
It’s important to get to the bottom of why and how your pedestrian accident happened. Knowing the cause will be critical in determining who’s at fault and, in turn, liable for your resulting damages.
Under Texas state law, liability can extend to any party that contributes to your accident, including motorists, other pedestrians, vehicle manufacturers, government agencies, or the employer of a negligent party.
Don’t stress out about how to recover compensation for your pedestrian accident or from whom. Trust our experienced pedestrian accident attorneys in Burnet to take a detailed approach to your case and work to recover all of the damages to which you’re entitled under the law.

What Types of Damages Can Be Awarded to Injured Pedestrians in Burnet?
When you file an insurance claim or lawsuit after getting hit by a car in Burnet, you’ll be able to seek compensatory damages.
Compensatory damages have two distinct purposes – to offset your financial costs and help you cope with harder-to-value trauma.
Known as economic damages and non-economic damages, respectively, they can include money for:
- Medical bills, including hospitalization, surgery, medication, and medical devices
- Lost wages and benefits
- Diminished earning capacity
- Disability
- Out-of-pocket expenses
- Rehabilitation
- Nursing care
- Pain and suffering
- Loss of consortium
- Reduced quality of life
- Emotional distress
- Disfigurement and physical scarring
- Chronic physical pain
- Embarrassment
Punitive damages can potentially be awarded if your pedestrian accident lawsuit goes to trial. A Burnet County jury can require the defendant to pay punitive damages if there’s compelling evidence they acted intentionally or with gross negligence.

Can Shared Fault Affect My Texas Pedestrian Accident Settlement?
Yes. Texas’s modified comparative negligence statute will apply to civil pedestrian accident lawsuits. As a result, sharing more than half of the blame for your pedestrian accident will prevent you from recovering compensation from a third party.
You’ll be able to recover a limited monetary award if you share some of the blame for your accident. For instance, sharing 10 percent liability would result in a 10 percent reduction in damages.
Liable parties and insurance companies won’t hesitate to point fingers and try to blame you for getting hurt. If you don’t fight back against these allegations, it could limit your ability to recover compensation.
At Attorney Brian White Personal Injury Lawyers, our Burnet pedestrian accident attorneys will be prepared to defend against these tactics and work to help you secure the substantial financial award you need and deserve.
Common Pedestrian Accident Injuries
Pedestrians have little protection in the event of an accident.
So, when you’re struck by a motor vehicle, the resulting physical injuries can be catastrophic, including:
- Broken bones
- Nerve damage
- Burn injury
- Crushing jury
- Chest injury
- Concussion injury

- Spinal cord injury
- Back injury
- Eye injury
- Neck injury
- Soft tissue injury
- Paralysis injury
- Amputation injury

When a car accident involves a pedestrian, it’s important to report it to the local police right away. Then, make sure you seek medical attention at the closest emergency room. Prompt medical treatment can help to limit the extent of your injuries and ensure they’re documented properly.
What’s the Time Limit For Filing a Pedestrian Accident Lawsuit in Texas?
Texas has a two-year statute of limitations that applies to most pedestrian accident lawsuits. So, you’ll generally have two years from the date of your pedestrian accident to sue for damages.
The two-year statute of limitations also applies to matters of wrongful death following a fatal pedestrian accident but begins to run on the victim’s date of death.
You have to meet the filing deadline if you want to recover compensation from a negligent party or insurer. Once the statute of limitations runs out, so does your right to demand the money you deserve.
