Speeding Is a Major Cause of Car Accidents
Speeding is one of the leading causes of automobile accidents in Texas and is a contributing factor in nearly one-third of fatal crashes. According to the Texas Department of Transportation, speeding was a factor in more than 160,000 crashes in 2023.
Speeding accidents are more frequent on large highways and rural roads and are more likely to happen on the weekends and late at night. We have seen firsthand the devastation that a speeding driver can cause and believe that victims deserve a chance to hold responsible parties accountable for the harm they’ve caused.
Why Speeding Makes Crashes More Severe
Speeding does more than increase the chance of a crash; it also magnifies the consequences. A faster driver has less time to react and needs more distance to stop, and the added force of impact is transferred to the people involved. That’s why speeding crashes so often cause catastrophic injuries.

Punitive Damages for Speeding Accidents
Texas allows the awarding of additional punitive damages in personal injury cases where the offender acted with malice, fraud, or gross negligence. For example, if they were speeding significantly above the posted speed limit, their actions may cross the threshold for allowing punitive damages.
Punitive damages in Texas are generally capped at the greater of $200,000 or two times your economic damages plus an amount equal to your non-economic damages (up to $750,000). However, the cap does not apply in certain cases, such as when the driver’s conduct involved specific felony offenses listed under Texas law (for example, intoxication manslaughter).

Time Limit for Filing a Lawsuit in Texas
You generally have two years to file a lawsuit for a speeding accident in Texas, per Texas Civil Practice and Remedies Code § 16.003. Once the statute of limitations runs out, you will lose any chance to recover compensation through legal channels. The two-year timer generally starts counting from the date you sustained your injuries.
Even though you have two years, you shouldn’t wait to get started. Waiting to collect evidence and medical documentation can harm your case. Instead, you should talk to a lawyer as soon as possible and initiate the claims process.
