Potential Damages You Could Recover
The type of damages available will depend on the type of accident, the at-fault party, and the specific circumstances surrounding your claim. However, because catastrophic injuries often require ongoing care and lengthy treatment plans, the financial losses are usually much greater.
Fortunately, a Jersey Village catastrophic injury lawyer can assess your situation and calculate the full value of your claim. We’ll base this estimate on both economic and non-economic damages, now and in the future.
Economic Damages
You may be able to recover economic damages for emergency medical treatment, ongoing and future medical care, rehabilitation, physical therapy, hospital stays, and other medical expenses associated with your catastrophic injury.
If you lose work or your earning capacity changes because of the accident, you may also be able to claim compensation for this.
Non-Economic Damages
Catastrophic injuries affect more than your physical health. They can completely change your life in a variety of ways. That’s why we’ll also pursue non-economic damages.
This compensation usually covers more subjective losses, like the emotional trauma you’ve experienced as a result of the catastrophic injury, physical pain and suffering, loss of enjoyment of life, and permanent disability.

Who Is Liable for a Catastrophic Injury Claim?
If your catastrophic injury was caused by the negligent actions of another party, they are usually the ones who can be held liable.
For example, if you were in a motor vehicle accident that left you with a traumatic brain injury, you may be able to hold the reckless driver who caused the crash responsible. If your injuries occurred because of a dangerous product, the manufacturer may be to blame.
In some instances, multiple parties may even share responsibility. It all depends on what happened, where it happened, and who may have contributed. Your catastrophic injury attorney in Jersey Village can review the evidence and listen carefully to your testimony to try to identify who is responsible for your catastrophic injuries.

How Texas’ Negligence Laws May Impact Your Claim
Texas follows a proportionate responsibility system when it comes to determining fault and claiming compensation. Under this law, if you are more than 50% at fault for your catastrophic injuries, you may be barred from recovering any damages.
However, that doesn’t mean you must be completely free of blame in order to claim compensation. If you are found to be 50% or less at fault for your injuries, you may still be able to recover damages. However, your settlement amount will be reduced based on your percentage of responsibility.
Insurance companies sometimes try to use this law to their advantage by blaming you for the accident. Our attorneys will always fight back against unfair claims and challenge the tactics used by insurers to reduce payouts.

How Long Do You Have to File a Catastrophic Injury Lawsuit?
According to Texas’ statute of limitations, you generally have two years from the date of your injury to file a lawsuit, per Texas Civil Practice and Remedies Code § 16.003. If you miss this deadline, you may forfeit your ability to recover compensation.
While there are some exceptions to this rule, it’s usually best to stick to this timeline as strictly as possible. Our legal team can advise on how much time you have left to file your lawsuit and help to speed things along so that you don’t miss out.
