Insurance Coverage for Uber Accidents in Texas
Texas follows a fault-based insurance system. Rideshare accidents can bring added complexity to this system. Uber must maintain large insurance policies that may apply depending on the driver’s status at the time of the crash. Here’s how coverage usually works:
- Driver not logged into the app: If the Uber driver wasn’t logged into the app at the time of the rideshare accident, only the driver’s personal auto policy applies.
- Driver logged in, waiting for a ride: If the Uber driver was logged in to the app but hadn’t yet accepted a ride request when the rideshare accident occurred, Uber provides limited liability coverage. This coverage generally provides $50,000 per person and $100,000 per accident for bodily injury, plus $25,000 for property damage.
- Driver accepted a ride or transporting a passenger: Uber’s $1 million liability policy is in effect.
Insurance companies almost always fight to avoid paying the full value of a claim, no matter how strong it may be. Our Uber accident attorneys in Houston can review the facts of your case and determine which coverage applies in your situation.

What Compensation Can You Recover From a Rideshare Accident Lawsuit?
Victims tend to incur two types of losses after a rideshare accident: economic and non-economic. The settlement you request from an insurer should cover the value of those losses if you want to come away from your accident financially unscathed.
Your rideshare accident’s economic losses tend to leave a paper trail in the form of medical invoices, pay stubs, and mechanics’ fees. These losses can include your emergency medical treatments, medical prescriptions, upcoming surgeries, property damage repairs, and lost wages.
Your rideshare accident’s non-economic losses do not have a pre-set financial value or bills. These tend to include your pain and suffering, emotional distress, and reduced quality of life, all of which we can assess when you meet with us to build your case.

How to Prove Your Right to Rideshare Accident Damages
If you want to prove that you have the right to request accident damages after a collision with a rideshare vehicle, you need to gather enough data to meet the state’s burden of proof.
We can connect you with investigators who can get the job done, giving you the time you need to get essential medical treatment or start going back to work.
The evidence that we use to argue for your right to comprehensive financial support can include:
- Electronic data from a rideshare app
- Witness statements
- Physical debris
- Photos from before, during, or after your accident
- Police reports
- Video footage of your accident, including footage from dashboard cameras or security cameras
- Expert testimony, including input from emergency responders
The Deadline for Filing a Personal Injury Lawsuit in Texas
Under Texas law, you generally have two years from the date of your accident to file a personal injury lawsuit. If you miss the deadline, you may lose your right to compensation entirely.
Certain circumstances can shorten or extend this period, but it’s always best to act quickly. The sooner you involve our Uber accident attorney in Houston, the sooner evidence can be preserved, and your case can move forward.
