Around midnight on Thursday, March 15, 2012 a major accident at the intersection of Fallbrook and Sam Houston Parkway in Northwest Harris County left tow seriously injured.

As a flatbed wrecker driver was traveling Eastbound, in route to another accident scene a car traveling Northbound slammed into the side of the wrecker causing it to lift into the air and hit a traffic light pole.

Rescue crews had to use the rescue jaws to pry the two men out of the car. One of the men from the car was transported to an area hospital by life flight, while the other man from the car was taken to same hospital by ambulance in stable condition. The tow truck driver did not sustain any injuries.

It has yet to be determined who was responsible for the accident due to the fact both the driver of the flatbed tow truck and the driver of the car claim to have had the green light.

On September 22, 2011 the 584 foot Luminous Ace, with 25 crew members, was headed towards California when an electrical outage caused the Luminous Ace’s pilot to lose control of the wheel. Due to the electrical outage the Luminous Ace lost all stearing capabilites, causing the Luminous Ace to drift outside the navigation channel and grounding around a 100 yards from the shore. In order to prevent the Luminous Ace from drifting farther the crew dropped anchor.

While two tugboats were headed to the scene and the Luminous Ace was grounded the Luminous Ace was able to restore electrical power. Shortly after electrical power was restored and before high tide the Luminous Ace floated free and was assisted to an anchorage near Astoria. After passing inspection by the Coast Guard on September 24, 2011 the Luminous Ace was allowed to continue on to its destination.

Out of the 25 members of the crew, no injuries were reported and the investigation is still on going to discover what the cause of the electrical outage was.

Under the Jones Act if any crew members had been injured or died due to incident the crew members and/or family members would have a right to seek compensation for pain, suffering, and loss.

On the morning of October 29, 2011 the National Transportation Board stated the pilot of a 799ft chemical tanker, Elka Appolon, contained Naptha and 24 crew memebers collided with the 782ft container ship, MSC Nederland, containing 1023 containers near the intersection of Bayport Ship Channel.

The pilot of the Elka Apollon gave his crew left rudder orders in attempt to avoid the towboat, which was pushing a fuel barge, sending the Elka Apollon to the left in the same direction of the in bound MSC Nederland. The next orders the pilot gave the crew of the Elka Apollon was a hard starboard rudder to avoid the MSC Nederland. The pilot of the MSC Nederland realized Elka Apollon was headed straight for his ship and gave an emergency full ahead and hard to port order in attempt to avoid the bow of the Elka Apollon. Even with both pilots attempting to avoid a collision the Elka Apollon’s port bow area and MSC Nederland’s port side on the main deck level collided. The impact caused three of the shipping containers from the MSC Nederland to fall on the forward deck of the Elka Apollon. One of the containers that ended up on the Elka Apollon contained tractor equipment leaking hydraulic fluid onto the deck. In this event there were no injuries reported by the crew members, but in the case where there were injuries to crew members they would have rights for compensation for injuries, pain, and suffering under the Jones Act.

On September 7, 2011 as Tropical Storm Nate was quickly turning into Hurricane Nate, the captain of the Trinity II, located in the Bay of Campeche, requested for ships in the area to help evacuate his crew of 1o, with no answer or committment to come help the 10 were forced to evacuate on September 8, 2011 after a starboard leg failed. As they prepared for evaction the fully stocked 25 man rafts blew away leaving only a 12 man life float and life vests for the 10 men.

Within 48 hours the men had become dehydrated, hallucinating and in pain. After the seawater had eaten their tongues and lips the men were forced to drink their own urine in hopes of survival. Within those first 48 hours of being lost in the seas they lost four of the 10 men to death. The first man to pass was Aaron Howeling of Australia, who was hired by Geokinectics Inc. based out of Houston, Texas, it is said he was having a mental breakdown he kept untying himself from the raft, had shivers, and lips had turned purple. The second to pass was Nicholas Reed who was an employee of Trinity Liftboat Services of New Iberia, Louisiana, it is said became disoriented and died from drowning. Kham Nadimuzzan from Bangladesh who was also hired by Geokinectics Inc. out of Houston, Texas, died after eating seeds from lilies that floated by. On September 10, 2011 the last death came, Craig Myers another employee of Trinity Liftboat Services of New Iberia. Even though there were still six men alive all had severe sunburn and some form of organ failure. These men and their families have rights for compensation for the deaths injuries, pain, and suffering under the Jones Act, which was established in 1920.

On September 11, 2011, day three of being in the waters The Bourbon Artabaze found the float first even though Desire, one of the six survivors had been following the boat for quite some time that afternoon only to have it turn around on him leaving him looking at the stern. Filled with frustration Desire saw an airplane in the sky and within 10 minutes the boat turned around again heading towards him. Once he reached the boat he climbed on board to discover the rest of the crew were already on stretchers receiving medical attention and water.

Parfait, one of the six survivors o the tradegy of the Trinity II, states the evacuation plans need to be prepared prior to an incident occurring. He also stated that the non-marineers like the cleaning crew and two gentlemen from Geokinetics that were aboard the Trinity II, be required to undergo the same water survival training the mariners go through. He feels these guys were not given a fair chance at survival because they did not know the tools for survival. With their rights not being protected and many errors made while they were on the seas the families of the deceased and the injuried members of the crew have rights to being financially protected under the Jones Act, which was established in 1920.

Late in the evening on Friday January 13, 2012 there were 3,206 passengers and 1,023 crew members on board when the Costa Concordia Cruise Ship. Many of the passengers had sat down for dinner on the Costa Concordia as they were joltedas the Costa Concordia hit a land formation in the water causing a 160 foot along the left side of the hull allowing water to pour into the ship due to an authorized move from the captain, 52 year old Francesco Schettino. Early morning on Saturday January 14,2012 all passengers and crew members were being forced to evacuate . This evacuation happened with out a prior evacuation drill from the crew of the Concordia, because it was scheduled for that Saturday evening. The standard lowering of the life boats into the waters could not take place due to the tilting of the ship the life boats could not be lowered. With no life boats passengers and crew members were left with only life jackets as many jumped into the water where the temperature was 8 degrees. At this time there is 11 confirmed dead and around 24 still missing.

Costa Cruises is stating this accident was a result of human error of Captain Schettino. They also state the captain did not follow procedures as he was trained many times and had always passed his training classes.

As of January 17, 2012 Captain Francesco Schettino of Costa Concordia was arrested and placed under house arrest until the investigation is completed. There is a possibility of the captain facing charges of manslaughter, shipwreck, and abandoning a ship with passengers still on board. According to transcripts of questions between officials and Schettino, Schettino stated he did abandon the ship, but has since recanted that statement stating he was “catapulted” from the ship. Schettino has also stated he is comforted due to making the emergency move placing the ship in shallow waters.
